Metra Train Crash 29.6 Million Dollar Verdict
On February 27, 2009, a Cook County Jury returned a verdict in the amount of $29,600,000.00 against Metra for injuries caused in the train derailment case that happened in September of 2005. While Metra admitted liability, nature and extent of the plaintiff's injuries, and proximate cause, they only wanted the jury to give the plaintiff $16,000,000.00. Mark Horwitz, of the Discount Law Firm, represents Marie Bullock. Ms. Bullock was on the same train and in the same car as the plaintiff who was just awarded this verdict. Ms. Bullock's case is set to go to trial in the Spring or Summer of this year. Up to this point, AIG, who insures Metra, has been unwilling to offer any settlement on Ms. Bullock's case despite the fact that she has endured 4 surgeries on her leg and ankle, has post traumatic stress disorder, reflex sympathetic dystrophy and regional complex pain syndrome. Mark Horwitz has demanded $5,000,000.000 to settle this case, but with the jury's verdict coming back the way they did on February 27, 2009, Mr. Horwitz may now withdraw that demand and raise it to $10,000,000.00.
